Terms of Use
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE ONLINE ORDERING SYSTEM 

Terms & Conditions of Avoca at Home Catering Food Online Ordering, trading as Avoca Handweavers Shops Limited, a company incorporated in Ireland with company number 46106 with a registered office at 70 Sir John Rogerson’s Quay, Dublin 2, Ireland. 

Introduction 
By availing of the Online Food Ordering System, you agree to the terms and conditions set out below in the “Terms of Use”. The Terms of Use is a binding legal agreement between the Avoca Food Market (“us”, “we” or “our”) and you. We may change the Terms of Use from time to time to the extent permitted by applicable law. Please read the Terms of Use carefully, if you do not agree to any of them, you will not be entitled or permitted to use the Online Food Ordering System and you must refrain from doing so.   

Intended Use 
The purpose or intended use of the Online Food Ordering System is to provide a convenient service enabling our customers to place orders online for a collection of select food market items and/or other items. You are granted a right to use the Online Food Ordering System in accordance with the Terms of Service outlined below.   

Disclaimer & Liability 
By use of this system, you hereby acknowledge and agree to the terms outlined below. The Online Food Ordering System is made available for use ‘as is’ and we make no representations and give no warranties in relation to the Online Food Ordering System and that, without prejudice to the generality of the foregoing, we make no warranty or representation regarding and shall have no responsibility for, the accuracy, availability, reliability, security, fitness for purpose or performance or continuity of the Online Food Ordering System or the contents thereof. It is your sole responsibility to ensure that the Online Food Ordering System is suitable for your purposes.  The Online Food Ordering System may at any time and without notice, be modified, or withdrawn (temporarily or permanently), and we shall have no liability to you or any other party arising out of or in connection with such modification or withdrawal. We make no representation or warranty that the Online Food Ordering System will be uninterrupted, error-free, free of viruses, or will meet your requirements or specifications. Any/ all warranties, guarantees, terms, and conditions whether express or implied in relation to the Online Food Ordering System or the information contained therein (including any implied warranty of the accuracy of data, non-infringement, merchantability, or fitness for a particular purpose) are hereby excluded to the fullest extent permitted by applicable law. 

Use of Data 
Your personal details mobile phone number, customer name, and address is required to process an order through the Online Food Ordering System, you will be providing us with this information so that we can complete your order.  Upon entering your payment card details on the Online Food Ordering System, your details will be stored securely by a third-party payment service provider. We do not have access to your payment card details, except for the last 4 digits of your payment card number and the card expiry date which are used to identify your card and orders.  For further information on how we may process information about you please see our Privacy Policy.    

Marketing & Communication 
When registering an account with our Online Food Ordering System you are given the option to opt-in for marketing and communications from Avoca. You can opt-out at any time via the app, email footer, or by contacting Avoca. If/when you consent to receive marketing communications we will provide you with notices and other communications electronically either through the Online Food Ordering System App or by other electronic means.    

Cancellation 
Cancellation of orders from the Avoca catering menu must be made 72 hours before the scheduled collection date. Customers who cancel after the cut-off time will be charged the original order value. Please acknowledge that we may cancel an order placed by you on the Online Food Ordering System, either before or after acceptance of such an order, where we believe that inaccurate information was provided to us.

Amendments 
We allow amendments to any order, however, these amendments must meet our 4-day lead time to allow us time to hand-prepare your freshly made items. If short notice, contact the food market you’re collecting your order from, and they will do their very best to accommodate you with the item you want or suggest a suitable alternative. If the amendment to your order is an exchange of items then we will refund you for the items you no longer want, and you can purchase the new item online or through our food markets. Please ensure you cancel any items you don’t want 72 hours before the scheduled collection date.     

Returns 
We accept returns, where the items collected, were incorrect due to an error on our end or not of merchantable quality at the time of collection.    

Alcohol 
You must be capable of proving proof of age upon collection of any product containing alcohol. If requested, the validation of the proof of age (over 18 years of age) will be at the discretion of our staff.   

Products & Pricing 
We strive to ensure that all product descriptions and pricing are correct at the time of ordering. If an error is discovered, we will contact you and give you the option to collect at the correct prices or cancel your order. You have the right to decline, and we will refund the full amount taken from your credit/debit card at the time of ordering. Please note, prices are inclusive of VAT.     We reserve the right at our discretion to change the products, and the prices of products, available on the online food ordering system.     

Orders 
It is your responsibility to ensure that your correct personal details are entered when placing an order, incorrect details may lead to delays or cancellation of your order. Avoca is not liable for any delay or failure to complete your order due to incorrect personal details. It is your responsibility to ensure each order for products that you place through the Online Food Ordering System is correct prior to you submitting such an order. All questions that you may have regarding products displayed, or any orders you place through, the Online Food Ordering System should be directed to us using the Store’s contact details available on our website.    

Please note, any order placed through the Online Food Ordering System is not accepted until you are receive confirmation from Avoca that we have received and accepted your order. This means that when the Online Ordering System states that your order has been confirmed, we may still (at our discretion) choose to decline your order until such time as you are sent the SMS. If we are unable to accept your order after it has been placed through the Online Food Ordering System, we will contact you to confirm this to you.     

Payments   
Card details are encrypted during online processing to protect your information. The authority of the cardholder is required to complete a purchase. We may contact you and your issuing bank to validate this authority. 

Avoca Gift Cards
Unfortunately, the food ordering system does not support the use of Avoca gift cards for payment.

Deposits   
The purchase of products that are labeled as ‘deposit’ on the platform constitutes a part payment for an item, and the balance will be due upon collection. Please note that if you have not made payment in full at the time of placing your order on the Online Food Ordering System, you will be solely responsible and liable for making all outstanding payments due in respect of your order at the time that you collect your order from us.
